How a Buyback Is Calculated

Under most lemon laws, a buyback (repurchase) starts from what you paid and subtracts a usage offset — a deduction for the miles you drove before the defect was first brought in for repair. The common formula divides those early miles by a statutory number (often 120,000) and multiplies by the price:

  • Start with the purchase price plus collateral charges like sales tax, title, registration, and finance charges
  • Subtract the usage offset = (miles at first repair ÷ state denominator) × purchase price
  • Attorney's fees are usually separate — under the federal Magnuson-Moss Act a prevailing consumer can recover them from the manufacturer
