The Law That Applied

New York Lemon Law - New Car Lemon Law and federal warranty law

New York's New Car Lemon Law (N.Y. Gen. Bus. Law ยง198-a) covers new vehicles bought, leased or registered in the state. The defect has to be reported within 18,000 miles or 2 years of delivery, whichever is earlier. From there, the law looks for 4 repair attempts on the same defect or 30 or more calendar days out of service in total. If the manufacturer has its own dispute program, the owner must use it before seeking a refund or replacement. New York's state arbitration program is optional, but every manufacturer must take part when an owner picks it. A claim can be brought within 4 years of delivery. A court may award reasonable attorney fees to an owner who prevails, and the remedies are a replacement or a refund less a reasonable offset for use.

This EV6 had 4 repair visits for one defect, the air conditioning, and 39 days out of service, which is beyond the 30-day test. The first failure came in June 2024, less than a month after delivery and well inside the 2-year window. The federal Magnuson-Moss Warranty Act (15 U.S.C. ยง 2301 et seq.) can give an owner a companion claim for a written warranty that was not honored, and it may allow recovery of attorney fees.

How We Built the Claim

How RockPoint built the claim

There was a single defect running throughout the record. The AC failed in the first month, failed again the next day, and kept failing after the dealer replaced the expansion valve and then the low-pressure line.

The days told the same story. With 39 days out of service, the EV6 had spent more time at the dealer than New York's 30-day test requires, and the problem was still unresolved at the last visit.
